TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your enrolment in and participation in The Clear Skin Code ("Programme"), operated by Tommi Rose Natural Health (ABN 21 126 540 128) ("we", "us", "our").

By purchasing, accessing, enrolling in, or participating in the Programme, you acknowledge that you have read, understood and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not purchase or access the Programme.

1. PROGRAMME DETAILS

The Clear Skin Code is a twelve (12) week educational group programme designed to provide information, resources, education and support relating to skin health, nutrition, lifestyle factors and wellbeing.

The Programme may include:

pre-recorded educational content;

downloadable resources;

templates, worksheets and guides;

access to a private Skool community;

email support;

group support within Skool; and

other educational resources made available by us from time to time.

No live coaching calls form part of the Programme unless expressly stated otherwise.

Whilst the Programme is delivered over a twelve (12) week framework, participants receive ongoing access to Programme materials in accordance with clause 4.

2. EDUCATIONAL PURPOSES ONLY

The Programme is provided solely for educational and informational purposes.

The Programme does not constitute:

medical advice;

naturopathic advice tailored to your individual circumstances;

diagnosis;

treatment recommendations;

healthcare services;

psychological services; or

the establishment of a practitioner-patient relationship.

Information shared within the Programme is general in nature and is not intended to replace consultation with your doctor, specialist, allied health practitioner or other appropriately qualified healthcare professional.

You acknowledge and agree that:

(a) you are solely responsible for decisions relating to your health and wellbeing;

(b) you will seek appropriate medical advice regarding any health concerns;

(c) you will not delay, disregard or discontinue medical care based on information obtained through the Programme; and

(d) any implementation of information obtained through the Programme is undertaken entirely at your own discretion and risk.

If you are pregnant, breastfeeding, have a diagnosed medical condition, take prescription medication, or have concerns regarding your health, you should seek advice from your healthcare provider before implementing any changes.

3. NO GUARANTEE OF RESULTS

Individual outcomes vary significantly.

Participation in the Programme does not guarantee:

clearer skin;

symptom resolution;

improvements in acne severity;

hormonal improvements;

digestive improvements;

improved wellbeing; or

any particular outcome whatsoever.

Testimonials, examples, participant experiences and success stories are illustrative only and are not intended to represent typical results.

Results are influenced by numerous factors outside our control, including individual health status, adherence, genetics, environmental exposures, lifestyle factors and pre-existing conditions.

To the maximum extent permitted by law, no representation, warranty or guarantee is made regarding outcomes.

4. PROGRAMME ACCESS

Upon successful enrolment and payment, you will receive:

access to the twelve (12) week Programme curriculum; and

lifetime access to Programme materials hosted within the Programme platform.

For the purposes of these Terms, "lifetime access" means access for so long as The Clear Skin Code continues to be operated by Tommi Rose Natural Health.

We reserve the right to:

update, improve or modify Programme content;

retire, replace or remove resources;

migrate the Programme to another platform;

discontinue the Programme upon reasonable notice.

Should the Programme cease operating entirely, lifetime access cannot be guaranteed indefinitely.

5. SKOOL COMMUNITY ACCESS

Access to the private Skool community is provided as a benefit of enrolment.

Participants agree to conduct themselves respectfully and professionally.

You must not:

harass, intimidate or abuse other participants;

discriminate against others;

provide medical advice to other participants;

promote products, businesses or services without our written approval;

solicit Programme members;

share another participant's personal information;

engage in unlawful conduct;

post defamatory, threatening or offensive material.

We reserve the right, in our absolute discretion, to remove content or revoke community access where conduct is considered inappropriate.

Removal from the Skool community does not entitle you to a refund.

6. EMAIL AND GROUP SUPPORT

The Programme includes access to email support and group support within Skool.

Support is intended to provide clarification and educational guidance relating to Programme content.

Support does not include:

personalised naturopathic treatment;

diagnosis;

individual clinical advice;

emergency support;

urgent healthcare advice;

unlimited access; or

comprehensive case review.

We endeavour to respond within reasonable business timeframes; however, response times are not guaranteed.

Support availability may vary during public holidays, periods of leave, illness or other circumstances beyond our control.

7. INTELLECTUAL PROPERTY

All Programme content remains the exclusive property of Tommi Rose Natural Health.

This includes, without limitation:

videos;

educational content;

frameworks;

graphics;

templates;

worksheets;

downloads;

methodologies;

branding;

logos;

community resources; and

written materials.

Your enrolment grants you a limited, revocable, non-transferable, non-exclusive licence for personal, non-commercial use only.

You must not:

copy;

reproduce;

distribute;

republish;

sell;

adapt;

modify;

translate;

upload;

record;

screenshot for redistribution;

create derivative works from; or

commercially exploit

any Programme material without our prior written consent.

8. ACCOUNT SECURITY

Your access credentials are personal to you.

You must not share your login details with any third party.

You are responsible for maintaining the confidentiality of your account information and for all activities occurring under your account.

Unauthorised sharing may result in immediate suspension or termination of access without refund.

9. FEES AND PAYMENT

Programme fees are payable as selected at checkout.

Participants may choose:

(a) a one-off payment; or

(b) a payment plan consisting of three (3) instalments.

By selecting a payment plan, you authorise us and our payment processor to automatically debit the nominated payment method on scheduled payment dates.

Payment obligations remain binding regardless of:

your level of participation;

completion of the Programme;

use of Programme materials; or

changes in personal circumstances.

10. FAILED PAYMENTS

If an instalment payment fails:

we may attempt to reprocess payment;

your access may be suspended until payment is received;

outstanding amounts remain immediately due and payable.

We reserve the right to engage debt recovery processes in relation to unpaid Programme fees.

You agree to reimburse reasonable costs incurred in recovering outstanding amounts.

11. REFUND POLICY

Due to the immediate provision of digital content, educational materials and Programme access, all sales are final.

Except where required under the Australian Consumer Law, Programme fees are non-refundable.

Refunds will not be provided in circumstances including, but not limited to:

change of mind;

failure to participate;

inability to attend;

dissatisfaction arising from lack of implementation;

perceived lack of results;

failure to complete the Programme;

personal scheduling conflicts; or

withdrawal from the Programme.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

12. AUSTRALIAN CONSUMER LAW

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer rights or guarantees conferred by the Competition and Consumer Act 2010 (Cth) or other applicable legislation.

Where permitted by law, our liability is limited to:

(a) re-supplying the relevant services; or

(b) paying the cost of having the services supplied again.

13. TESTIMONIALS AND MEDIA CONSENT

If you voluntarily provide testimonials, reviews, comments or feedback, you grant us a perpetual, royalty-free, worldwide licence to use such material for marketing and promotional purposes.

We will not publish sensitive health information alongside testimonials without your express consent.

You may withdraw consent for future use by notifying us in writing.

Withdrawal does not apply retrospectively to materials already published.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Tommi Rose Natural Health excludes liability for any indirect, consequential, incidental, special or exemplary loss or damage arising out of or connected with participation in the Programme.

You acknowledge that participation is voluntary and undertaken entirely at your own risk.

Our aggregate liability arising from the Programme shall not exceed the amount paid by you for enrolment in the Programme.

Nothing in these Terms excludes liability that cannot lawfully be excluded.

15. INDEMNITY

You agree to indemnify and hold harmless Tommi Rose Natural Health, its owners, contractors, employees, agents and representatives against all claims, losses, liabilities, costs and expenses arising directly or indirectly from:

your breach of these Terms;

misuse of Programme content;

unlawful conduct;

infringement of intellectual property rights; or

reliance upon Programme information contrary to these Terms.

16. TERMINATION OF ACCESS

We reserve the right to suspend or terminate your access to the Programme, without refund, where you:

breach these Terms;

engage in abusive or inappropriate conduct;

infringe intellectual property rights;

share Programme access;

fail to make required payments; or

compromise the safety or integrity of the Programme community.

Outstanding payment obligations survive termination.

17. FORCE MAJEURE

We shall not be liable for any delay or failure to perform obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to:

illness;

natural disasters;

acts of government;

internet outages;

platform failures;

cyber incidents;

labour disputes; or

acts of God.

18. DISPUTE RESOLUTION

Where a dispute arises, both parties agree to first attempt to resolve the matter through good faith negotiations.

If the dispute cannot be resolved within thirty (30) days, the parties agree to participate in mediation before commencing court proceedings, except where urgent interlocutory relief is required.

19. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

The parties submit to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

20. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

21. ENTIRE AGREEMENT

These Terms constitute the entire agreement between the parties relating to participation in The Clear Skin Code and supersede all prior discussions, representations and understandings.
